In 03-4792, the Government noted
an appeal from the district court's order of October 2, 2003
imposing sanctions for non-compliance with orders regarding
defense access to certain witnesses. The Court heard argument
on December 3,2003, and issued its
opinion
on April 22, 2004. On June 3, 2004, the Court held a
closed hearing in connection with appellee's petition for rehearing.
On September 13, 2004, the panel granted rehearing and filed amended
opinions.
Petition for rehearing en banc was denied, no member of the Court having requested a poll on the petition for rehearing en banc.
